Riders Like Me Terms Of Use

These Terms apply as between you, the User of this Website and Riders Like Me Limited (“we” and “us” and “our”), the owner(s) of this Website. Your agreement to these Terms and Conditions is deemed to occur upon your first use of the Website and on each occasion that you revisit.

1.  Definitions and Interpretation
The following terms shall have the following meanings:

“Account”
means collectively the personal/identifying information and credentials used by Users to access parts of the Website and to create Ads;
“Content”
means any text, graphics, images, audio, video, software, data compilations and any other form of information capable of being stored in a computer that appears on or forms part of this Website;
“Service”
means collectively any online facilities, tools, services or information that we make available through the Website either now or in the future;
“System”
means any online communications infrastructure that we make available through the Website either now or in the future. This includes, but is not limited to, Ads, email addresses and online forms;
“User” / “Users”
means any third party that accesses the Website and is not employed by us and acting in the course of their employment;
“Website”
means the website that you are currently using and any sub-domains of this site unless expressly excluded by their own terms and conditions;

2.  Intellectual Property

2.1   Subject to the clause 3 of these Terms and Conditions, all Content included on the Website, including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of us, or our affiliates. By continuing to use the Website you acknowledge that such material is protected by applicable United Kingdom and international intellectual property and other laws.

2.2  You agree that: you will not systematically copy Content from the Website with a view to creating or compiling any form of comprehensive collection, compilation, directory or database unless given Our express written permission to do so.
2.3  Subject to clause 2,4 you may not print, reproduce, copy, distribute, store or in any other fashion re-use Content from the Website unless given express written permission to do so by us.
2.4   Material from the Website may be re-used without written permission where any of the exceptions detailed in Chapter III of the Copyright Designs and Patents Act 1988 apply.
2.5   You may not use any information contained on this website whether placed there by us or a registered user to create or as part of a database as defined by  The Copyright and Rights in Databases Regulations 1997.

3.  Third Party Intellectual Property

3.1  The intellectual property rights subsisting in the Content of Ads belong to the Advertisers who placed those Ads unless it is expressly stated otherwise.
3.2  Where expressly indicated, certain Content and the intellectual property rights subsisting therein belongs to other parties.
3.3  The Content described in this Clause 3, unless expressly stated to be so, is not covered by any permission granted by Clause 2 of these Terms and Conditions to use Content from the Website. The exceptions in Clause 4 continue to apply.

4.  Fair Use of Intellectual Property

4.1  Material from the Website may be re-used without permission where any of the exceptions detailed in Chapter III of the Copyright Designs and Patents Act 1988 apply.

7.4   No part of this Website is intended to constitute advice and the Content of this Website should not be relied upon when making any decisions or taking any action of any kind.
7.5  We make no representation or warranty that any part of this Website is suitable for use in commercial situations or that it constitutes accurate data and / or advice on which business decisions can be based.
7.6  Whilst We use reasonable endeavours to ensure that the Website is secure and free of errors, viruses and other malware, you are advised to take responsibility for your own internet security, that of your personal details and your computers.

8.  Availability of the Website and Modifications

8.1  The Service is provided “as is” and on an “as available” basis. We give no warranty that the Website or the Service will be free of defects and / or faults. To the maximum extent permitted by the law we provide no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality.
8.2  We accept no liability for any disruption or non-availability of the Website resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and state-mandated censorship.
8.3  We reserve the right to alter, suspend or discontinue any part (or the whole of) the Website including, but not limited to, the Content available. These Terms and Conditions shall continue to apply to any modified version of the Website unless it is expressly stated otherwise.

9.  Limitation of Liability

9.1  To the maximum extent permitted by law, we accept no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of the Website or any information contained therein. Users should be aware that they use the Website and its’ Content at their own risk.
9.2  Nothing in these Terms and Conditions excludes or restricts our liability for death or personal injury resulting from any negligence on our part.
9.3  In the event that any of these terms are found to be unlawful, invalid or otherwise unenforceable, that term is to be deemed severed from these Terms and Conditions and shall not affect the validity and enforceability of the remaining Terms and Conditions. This term shall apply only within jurisdictions where a particular term is illegal.

10.  No Waiver
In the event that any party to these Terms and Conditions fails to exercise any right or remedy contained herein, this shall not be construed as a waiver of that right or remedy.
11.  Previous Terms and Conditions
In the event of any conflict between these Terms and Conditions and any prior versions thereof, the provisions of these Terms and Conditions shall prevail unless it is expressly stated otherwise.
12.  Third Party Rights
Nothing in these Terms and Conditions shall confer any rights upon any third party. The agreement created by these Terms and Conditions is between you and us.
13.  Communications

13.1  All notices/communications shall be given to us either by post to Our Premises at Riders Like Me, Masters Yard, Guildford Road, Westcott, Surrey RH4 3NG or by email to admin@riderslikeme.co.uk Such notice will be deemed received 3 days after posting if sent by first class post, the day of sending if the email is received in full on a business day and on the next business day if the email is sent on a weekend or public holiday.
13.2  We may from time to time, if you opt to receive it, send you information about our products and/or services. If you do not wish to receive such information, please unsubscribe from emails

14. Amendments
We may update these terms and conditions at any time. Any changes will be displayed on our website and your continued use of the website indicates your agreement to the changes which will be binding on you. Accordingly, you should check this page from time to time to take notice of any changes made.
15.  Law and Jurisdiction
These Terms and Conditions and the relationship between you and us shall be governed by and construed in accordance with the Law of England and Wales and we and you agree to submit to the exclusive jurisdiction of the Courts of England and Wales.

 

 

 

Riders Like Me Forum Rules
Posting messages and participating in any of the discussions requires your prior registration as an individual, business or events organiser. Please note that by accessing any of the forums on this website, you are bound by our Forum Rules, which apply in addition to the Terms of Use and Privacy Policy. Where there is any inconsistency between the Terms of Use and the Privacy Policy and these Forum Rules then the Forum Rules shall prevail.
The Forum Rules are intended to help foster friendly, respectful and pleasant interaction.
Please note that individual forums may apply additional specific rules.
1. Members must limit their registration to one account. Multiple accounts can be removed without notice.
2. Members will be friendly and respectful to other members and the Moderator. No direct or indirect personal attacks or insults of any kind will be allowed. Posts which antagonise, belittle or humiliate other members and/or the Moderator will not be tolerated, nor will racism, sexism, bigotry or abusive language.
Members who have personal issues with other members and the Moderator must resolve their differences outside the forum.
3. Private messages, along with other private correspondence, are not to be posted on the open forum without the permission of their original authors. If someone is concerned about the content of any such messages that they receive, they should report it to the Moderator at hello@riderslikeme.co.uk who will consider what action is to be taken.
4. Sales posts or “Want to Buy/Trade” posts, auctions or the like will be immediately deleted. Describing a sales transaction as a gift is still a breach of the Rules.
5. No posts promoting raffles, auctions, surveys, contests, coupons, marketing campaigns or related activities will be allowed.
6.. Please do not initiate or participate in political or religious debates.
7 Images in posts, signatures, avatars and profiles containing firearms, knives and weapons are not permitted.
8. Do not post any that would not be suitable for viewing at an average workplace or home should not be posted here, i.e. nudity and other adult themes and violent images are unacceptable.
9. Do not post any information which is illegal or which relates to illegal activities or hints at the same.
10. Don’t engage in dialogue with a troll or a spammer. Report them to the Moderator or use the “report post” button located in each post.
11. Do not post anything which breaches the copyright of any third party. Remember information which is viewable on the web does not mean that copyright has been waived.
12. Signatures should contain images with a combined size of no larger than 128px high and 1024px wide. Please limit any text to 5 lines of text in a reasonable font size/style Valedictions are not included in the 5 line maximum. While animated signatures are acceptable, please take care not to annoy others with flashing banners or other images that distract from the discussion.
13. Policy regarding links, signatures and avatars:

13.1. links to or naming of personal non -commercial websites/pages/content are permitted. The Moderator reserves the right to delete any questionable naming or links;
13.2. links to or naming of commercial ventures/websites/pages/content are prohibited unless it is your own site and that site has a listing in the Riders Like Me Directory;

13.3. advertising banners and avatars whether or not linked to a commercial venture, page or website are prohibited unless you are a sponsor;
13,4. links or references to competitive forum sites are not permitted
13.5. signatures and avatars should not contain religious texts, political statements, sexist remarks or any other offensive text or image.
13.6 Final arbiter of such signatures or avatars is the Moderator.

14. Please note that with regard to content posted on the Forum, we merely acts as a conduit, providing you access to the Forum. No content on the Forum should be taken as advice by us or as reflecting our views. The Forum is not actively moderated and messages are not screened before they are posted. Therefore, if you believe that content posted on any of the forums infringes any of your rights, please use the “report post” button located in each post or send a message to the Moderator, with detailed information about the alleged infringement. We will then look into your request within 2 working days.
15. Don’t reveal any other user’s personal information such as name, telephone number, photos etc.
16. Keep your replies on topic.
17. Do not spam the forums. This means replying to as many threads as you can in a short amount of time or posting a lot of consecutive messages in any particular thread.
18. Don’t quote messages excessively when replying. You only need to quote a particular part of the message if you are directly replying to it and a normal reply to a topic won’t suffice. Quoting whole messages to say “Yes” or “I agree” is unnecessary and will be counted as spamming if regularly repeated
19. Do not post messages in text-speak. Repeatedly posting in this way will count as offensive posting.
20. Before posting a new topic, use the search facility to ensure that what you are about to post hasn’t already been addressed. Failure to do so could result in your topic being deleted or blocked.
21. Please only post messages in English. While we welcome members from anywhere any posts that the Moderator cannot understand will be treated as breaking the rules.
22. If the moderating team feel that you are not adhering to the Forum Rules, the following procedure will be followed.

22.1 An email will be sent to you from the Moderator drawing your attention to the rules and the reasons why we feel you need to be reminded of them.
22.2 Should you not heed this warning and continue to break the rules: 
you will receive a temporary ban of seven days and an infraction that will last one month. You will receive notification via mail.

22.3 Further breaking of the Forum Rules will result in a permanent ban in the following situations:
22.3.1 You will receive a further infraction while you are already “booked.”

and/or

22.3.2 You reach a total of three separate infractions.

23. In addition to the above, committing breaches of clauses 2 to 11, will lead to an instant permanent ban.
24. The Moderator’s decisions is final. If you are in doubt about a post, please contact the Moderator hello@riderslikeme.co.uk before you submit your post. Membership of the forum can be revoked by the forum administration without any reason being given. The Moderator reserves the right to delete any questionable posts pending additional request for documentation.

25. We may update these rules at any time. Any changes will be displayed on our website and your continued use of the Forum indicates your agreement to the changes which will be binding on you. Accordingly, you should check this page from time to time to take notice of any changes made.
26 English law shall apply in the case of any dispute and the English Courts shall have sole jurisdiction.

Riders Like Me Directory

Users making entries as individuals or  businesses  must first register in the appropriate category/categories and are required to use a separate email address for each activity and must always use the appropriate email address.

I. Introduction

1.1 Your agreement to comply with and be bound by these terms is deemed to occur upon your first use and each subsequent use of the Website.

all which shall form part of the terms for use of the Riders Like Me Directory save that where there is any inconsistency there terms and conditions shall prevail.

You can find these policies in these Terms and Conditions.

1.3  Clubs, societies, charities, livery yards and event organisers can all insert free entries into the Riders Like Me Directory. Businesses and those not in these categories are required to pay for their entry. If there is any dispute as to whether an entry qualifies as a free entry, our decision will be final.

1.4  Individual and event organisers may be required to satisfy us that they are not a business.

1.5 Those making entries other than as businesses may be required to produce such evidence to us as we may request to validate their status.

2 Listing in the Riders Like Me Directory

2.1 When submitting a listing in the Riders Like Me Directory you accept and agree that it will be in accordance with the following rules:

2.1.1 You comply with the Agreement for Advertisers.

2.1.2 Your listing must be placed into the appropriate category – events, business etc;
2.1.3 You must not submit material that may contain viruses or any other software or instructions that may damage or disrupt other software, computer hardware or communications networks; and
2.1.4 You must not use the Website for unauthorised mass-communication such as “spam” or “junk mail”.
2.1.5 Promotions must not be run in the Riders Like Me Directory.

2.1.6 The Riders Like Me Directory will not be used to market items not related to equestrian activities.
2.1.7 You will not suggest in any entry that your entry or activities or your entry has in any way been approved of or endorsed by us.

3 Listing entry procedure

3.1 In order to submit a listing, you are required to submit certain personal details and/or business details.  By submitting a listing you warrant and represent that you are the author of that listing or that you have acquired all of the appropriate rights and/or permissions to submit it. We accept no responsibility or liability for any infringement of third party rights by such listings or the content.
3.2  You waive all moral rights in the listing to be named as its author and grant us a licence to modify the content as necessary for its inclusion on the Website.
3.3   We will not be liable in any way or under any circumstances for any loss or damage that you may incur as a result of such listings, nor for any errors or omissions.
3.4 The use of and reliance upon listings is entirely at your own risk.

4 Listing fees for businesses

4.1 If a business then in order to post a listing on this Website you must create an Account which will contain certain personal details.
4.2 You must keep your account details confidential and should not reveal your username or password to any unauthorised third parties.
4.3 Unless you come within a category referred to in 1.3, a listing fee will be charged for each listing you post as a business.
4.4 Listing fees are set out in the appendix below.
4.5 Your Paypal account/credit/debit card will be billed at the time at which your listing goes live and annually thereafter until removal, cancellation or termination.
4.6 Your first payment will be at the price advertised in the appendix below unless special offers apply. We reserve the right to change listing fees from time to time.

4.6.1 increases in price will be reflected in your recurring listing fees; and
4.6.2 decreases in price will be reflected in your recurring listing fees.

4.7 Discounts are available for multiple listings as set out in the appendix below

5 Removal, Termination and/or Suspension

5.1 If we discover or reasonably suspect that a business is masquerading as other than a business then the entry will be removed immediately.

5.2 If party inserting an entry as other than a business, refuses to provide evidence that they are not a business or cannot provide such evidence then their entry may be removed
5.3 You acknowledge that that we are not accepting responsibility for the accuracy or otherwise of the contents of your listing.
5.4 Even where consent has been given by us for more than one category but we subsequently consider that there has been an abuse or confusion then we may remove an entry or require modification of an entry,

5.5 Entries must be kept up to date and out of date entries removed. Without prejudice to this obligation, if we become aware an entry is out of date, then we may remove the same.

5.6  Reviews and ratings

         5.6.1  Riders Like Me is acting as a conduit providing access to Directory and Directory Reviews and Ratings are not actively moderated nor are reviews and ratings screened before they are posted.

          5.6.2  Any reviews and ratings  of businesses must be fair and accurate, complete and informed and not misleading by statement or omission.    Reviews and ratings  can only be made by members who have used the business pertinent to the review.  Reviews and ratings  deemed unfair and inaccurate by Riders Like Me Ltd (in its sole discretion) will be removed within 2 working days of Riders Like Me being notified  by email at hello@riderslikme.co.uk.

5.7  Any business or individual  who writes a malicious review of another business or which offers a financial or other inducement to make a favourable review about themselves or writes a favourable review about themselves will have their listing removed and account suspended within 5 working days of Riders Like Me being notified by email at hello@riderslikeme.co.uk.

5.8  In cases of severe breaches of the above, a listing  or individual membership may be removed and your account may be suspended or terminated. You will be informed by private email of the reasons.
5.9 If we terminate or suspend your Account as a result of your breach of these Terms and Conditions you will not be entitled to any refund. If you have multiple listings and not all are deleted, you will continue to be billed for those which remain active and will not be refunded for those which are deleted.
5.8 If you are suspended or terminated as above then you must not attempt to use the Website under any other name or by using the access credentials of another party, with or without the permission of that party.
5.9 Our decision on all these mattes will be final and no correspondence will be entered into.

6 Disclaimers

6.1 We make no warranty or representation that the Riders Like Me Directory will meet your requirements, that it will be of satisfactory quality, that it will be fit for a particular purpose, that it will be compatible with all systems, or that it will be secure.
6.2 Save for the publishing of listings, we have neither control over, nor involvement in, any listings and accept no responsibility for any actions taken, or any goods or services provided, by any listed business or activity.
6.3 Whilst we uses reasonable endeavours to ensure that the Riders Like Me Directory is secure and free of errors, viruses and other malware, all users are advised to take responsibility for their own security, that of their personal details and their computers.

A single business annual insertion fee is £20
If you have multiple business, please contact us for details of our discounts.Listings are free until January 2017.  The annual insertion fee will apply from this date.
Charges apply from the date the listing is submitted.

Businesses will be billed annually
VAT is payable where applicable

“  Event Organiser”              means any third party that registers with the Website as an Event Organiser

 

“ Purchaser”                            means any member of the Website  that enters or purchases a ticket for an Event Listing

 

“Event Listing”                       means an event listed on the Website

 

 

 

  1. Payment

 

2.1     Event Organiser will need a Paypal account to register for online entries/ticket sales.

 

2.2   Posting an Event Listing  is free.  Event Organisers listing their events and taking online payment will be charged Paypal costs only.  There is no service charge to Purchasers or Event Organisers. When a ‘Purchaser’ enters an event or books a ticket via the ‘Website’, the legal contract is between the ‘Purchaser’ and the ‘Event Organiser’.

2.3    Event Organiser agree that  payments are taken  through Paypal for  entries/ticket sales for their Event Listing and the ‘Purchaser’ pays the Event Organiser direct into the Event Organiser’s Paypal account.   Riders Like Me  do not hold any monies or  bank details.   Event Organisers will be notified of all individual entries/ticket sales of the Listed Event  into their Event Organisers Tack Room with its corresponding Paypal unique reference number.   You agree to unconditionally fulfil all event entries/ticket sales  that have been confirmed by the  Paypal  unique reference number and it is your responsibility to verify any event restrictions prior to the listed event.   You also agree to unconditionally fulfil all event entries/ticket sales when you manually Approve any booking.  Riders Like Me do not take responsibility for any payments made or received.

2.3  All payments to Event Organisers are  net of Paypal charges

2.4    All event entries and ticket sales, are payable in GB Pounds Sterling

2.5   Where payment is  by PayPal both parties accept that in addition to these terms and conditions both parties will be subject to PayPal rules.

 

 

3  Taxes

 

3.1    The Event Organiser is solely responsible for determining if any, value added, consumption, excise and other taxes, duties, levies and charges apply to event entries and ticket sales and for collecting, remitting and reporting the correct amounts of all such Taxes to the applicable governmental authorities.

4  Cancellations and Refunds

 

4.1  If an event has to be cancelled or significant changes made then full details must immediately be notified in the Events Listing by editing or cancelling an event

4.2    It will be the responsibility of event organisers to communicate  their refund policy.   If an Event Listing is cancelled, amended or if the ‘Purchaser’ is unable to attend it will be the sole responsibility of the event organiser to deal with refunds. Riders Like Me will not refund fees charged for transactions of cancelled events or when a Purchaser can no longer attend

4.3  Any payment disputes should be addressed through the Paypal dispute and resolution process. Riders Like Me do not take responsibility for any disputes.

 

 

5  Reviews

 

5.1  Any reviews of events must be fair and accurate complete and informed and not misleading by statement or omission. Reviews can only be made by competitors or users of the event venue

 

5.2   Any event organiser  who writes a malicious review  any other events organiser events or which offers  a financial or other inducement to make a favourable review about themselves or writes a favourable review about themselves, may be barred from Events Listing and the Business Directory

 

5.3   For any comments outside this area you must use the Forum

 

6  Removal of Event Listings

 

6.1  Event listings must be kept up to date.  On the date of the event, the listing  will automatically close, be removed from Event Listings but still be available to view in the Event Organisers Tack Room

 

6.2  In cases of severe breaches of the above your listing may be removed and your account may be suspended or terminated.  You will be informed by private email of the reasons

 

7  Disclaimers

 

7.1   Whilst we use reasonable endeavours to ensure that the Events Listing is secure and free of errors, viruses and other malware, all users are advised to take responsibility for their own security, that of their personal details and their computers

 

7.2   We make no warranty or representation that the Events Listing will meet your requirements, that it will be of satisfactory quality, that it will be fit for a particular purpose, that it will be compatible with all systems, or that it will be secure

 

7.3  You acknowledge that we do  not check insertions and that we  do not accepting responsibility  for the accuracy or otherwise of the contents or  for any actions taken, or any goods or services provided, by any listed business or activity

7.4 Those listing events must be aged 18 or over and if acting for a limited liability company must be authorised by the company to act

7.5  Our decision on all these matters will be final and no correspondence will be entered into.

Any changes will be displayed on our website and your continued use of the website indicates your agreement to the changes which will be binding on you. This agreement applies as between the Advertiser, (“you” and “your”) the user of this Website and Riders Like Me Limited (“us” and “we” and “our”), the owners of this Website. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first placing of an advertisement. If you do not agree to be bound by these terms and conditions, you should stop using the Website immediately.

1) Entry to the Promotion is restricted to one entry per person.
